This Privacy Policy describes how Shift Agent LLC (“Shift Agent,” “we,” “us,” or “our”) collects, uses, and shares information in connection with the Shift Agent website(s), mobile applications, software, and employee-scheduling and workforce-communication services (collectively, the “Services”), and the choices you have. This Privacy Policy is incorporated into and forms part of the Shift Agent Terms and Conditions (the “Terms”). Capitalized terms not defined here have the meanings given in the Terms. By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.
1.1 Who This Applies To. This Privacy Policy applies to business customers that subscribe to the Services (each, a “Customer”), to the individual end users authorized to use the Services under a Customer’s account (each, a “User”, typically a Customer’s managers and staff), and to visitors to our public website. Specifically, this Privacy Policy applies to:
1.2 What It Covers. It explains the types of information we obtain, how the information is collected, how it is used and shared, how it is retained and protected, and the rights and choices available to you. It does not apply to the practices of third parties that we do not own or control, including our payment processor and any third-party sites you access through links on the Services. This Privacy Policy does not govern Customer Data processed by Shift Agent on a Customer’s behalf through the Services. The collection, use, retention, and deletion of Customer Data at the platform level, including the aggregated and de-identified data practices described in Section 6 of the Terms, is governed by the Terms and, where applicable, any data processing addendum or agreement entered into between Shift Agent and the Customer.
2.1 Data Controlled by Customers. The Services are tools that Customers use to manage their own workforces. When a User accesses the Services under a Customer’s account, much of the information processed about that User (such as schedules, shifts, availability, time-off, and workplace messages) is provided and controlled by the Customer (the User’s employer or engaging entity). With respect to that information, Shift Agent acts as a service provider or processor on the Customer’s behalf and processes the information in accordance with the Terms and the Customer’s instructions. When acting as a service provider or processor, Shift Agent does not use information controlled by a Customer to develop or improve its products or services except in de-identified or aggregated form, and does not sell such information or share it for cross-context behavioral advertising. For a full description of how Shift Agent processes Customer Data as a service provider, including data ownership, permitted uses, and retention and deletion obligations, please refer to Sections 6 and 8 of the Terms.
2.2 Requests From Users. If you are a User and wish to access, correct, or delete information that your employer maintains through the Services, or to ask how that information is used, please contact your employer (the Customer) directly. We will assist the Customer as required by applicable law.
2.3 Data We Control. Shift Agent acts as a controller (a business that determines the purposes and means of processing) with respect to information we collect for our own purposes, such as account administration, billing, security, support, product improvement, and our communications with you.

3.3 Information From Other Sources. We may receive information about you from the Customer that authorizes your access to the Services, from our service providers (such as our payment processor and hosting and analytics providers), and, where applicable, from publicly available sources. We may also receive information through integrations or data-import features that allow a Customer to import employee or personnel records, including name, email address, and phone number, directly from third-party HR or workforce-management systems. Where information is imported in this manner, the Customer is responsible for ensuring that the import and our processing of that information is authorized and that any required notices or consents have been obtained from the individuals whose information is imported. We may combine any of the foregoing information with information we already hold.
3.4 Browsing Our Website. You can generally visit our public website without providing personal information, though we collect non-identifying usage data as described in Section 3.2.
We use the information we collect to:
5.1 SMS Notifications. The Services may use SMS/text messages to deliver scheduling and account notifications. Where required by law, we send such messages on an opt-in basis, and message and data rates may apply. You may opt out of recurring text messages at any time by replying “STOP” to a message or by adjusting your notification settings; opting out may limit certain functionality.
5.2 No Sharing of Mobile Opt-In Data. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties, except with vendors and service providers who need the information to help us operate the messaging functionality on our behalf (and who may not use it for their own purposes), as required by law or legal process, or with your consent.
6.1 What We Use. We and our service providers use cookies, web beacons, pixels, and similar technologies to authenticate Users, remember preferences and settings, maintain sessions, analyze site and app traffic and trends, and understand how the Services are used. Cookies are small files stored on your browser or device; web beacons help us measure usage and the effectiveness of communications.
6.2 Your Choices. Most browsers let you refuse or delete cookies. Depending on the applicable laws of your state, you may be able to reject non-essential cookies through a cookie banner or browser settings. Blocking some cookies may affect your experience, including your ability to log in. Other than service providers acting on our behalf, we do not permit third parties to use web beacons on the Services to collect your personal information.
6.3 Do Not Track. Some browsers offer a “Do Not Track” signal. Because there is no common industry standard for responding to these signals, we currently do not respond to them. We will update this Policy if that changes.
We do not sell your personal information. We share information only as described below:
We retain personal information while your account remains active and as needed to provide the Services, and thereafter as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and for legitimate business purposes. We may retain aggregated or de-identified information indefinitely. Where Shift Agent processes information on a Customer’s behalf, retention and deletion are governed by the Customer’s instructions and the Terms, and you should direct deletion requests to the Customer as described in Section 2.
9.1 Our Measures. We maintain administrative, technical, and physical safeguards designed to protect personal information, and we require our service providers to do the same. Payment and other sensitive data transmitted in connection with the Services is protected using industry-standard methods.
9.2 No Guarantee. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. To the maximum extent permitted by law, and except as otherwise required by applicable law, Shift Agent is not liable for unauthorized disclosure of information that occurs through no fault of Shift Agent, including errors in transmission or unauthorized acts of third parties. You are responsible for keeping your account credentials confidential and for notifying us of any suspected unauthorized use.
10.1 Account Information. You can review and update certain account information through your account settings. If you are a User, you may need to contact your employer (the Customer) to update information the Customer controls (see Section 2).
10.2 Marketing Communications. You may opt out of marketing emails by following the unsubscribe instructions in those messages. You may stop receiving text notifications at any time by replying “STOP” to any message or through your notification settings; note that all text messages we send are transactional and service-related, and we do not send marketing or promotional text messages. We will continue to send you non-promotional messages, such as receipts, account, security, and service notices.
10.3 Access, Correction, and Deletion. Subject to applicable law and the controller/processor allocation in Section 2, you may request access to, correction of, or deletion of personal information we hold about you by contacting us as described in Section 17. We may need to verify your identity before responding and may decline requests as permitted by law.
The Services are intended for businesses and their personnel, including individual employees who may be minors working under a Customer. We do not knowingly collect personal information from children under the age of 13. Users must meet the minimum eligibility requirements stated in our Terms. Where a Customer authorizes individuals under the age of 18 to use the Services as part of its workforce, the Customer is responsible for obtaining any parental, guardian, or other consents required by applicable law. If we learn that we have collected personal information from an individual under the age of 13 without appropriate consent, we will take steps to delete it.
12.1 Scope. This Section applies to California residents and uses terms as defined in the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”). It is unlikely that every category below applies to every individual.
12.2 Categories of Personal Information We Collect. In the preceding 12 months, we may have collected the following CCPA categories:
12.3 Sources and Purposes. We collect these categories from the sources described in Section 3 and use them for the business and commercial purposes described in Section 4.
12.4 Disclosures. We disclose personal information to the categories of recipients described in Section 7 (service providers, the Customer, affiliates, in business transfers, for legal/safety reasons, and as aggregated/de-identified data).
12.5 No Sale or Sharing. Shift Agent does not sell personal information and does not share personal information for cross-context behavioral advertising, as those terms are defined under the CCPA.
12.6 Sensitive Personal Information. We do not use or disclose sensitive personal information for purposes that would require us to offer a right to limit such use under the CCPA. We collect account login credentials as needed to provide the Services.
12.7 Your California Rights. Subject to verification and legal exceptions, you may request to know the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of recipients; request correction of inaccurate personal information; and request deletion of personal information. You are entitled to exercise these rights free from discrimination.
12.8 How to Exercise Rights; Authorized Agents. You may submit a request as described in Section 17. We will take steps to verify your identity, which may include matching information you provide with information we hold or contacting you through information already on file. You may use an authorized agent to submit a request, subject to the standards set by the California Attorney General. For Users whose information is controlled by a Customer, we will refer requests to the relevant Customer (see Section 2).
12.9 Shine the Light. California Civil Code § 1798.83 permits California residents to request information about disclosures of personal information to third parties for those third parties’ direct marketing purposes. Shift Agent does not disclose personal information to third parties for their direct marketing purposes.
Residents of certain other U.S. states may have rights to access, correct, delete, or obtain a copy of their personal information, and to opt out of certain processing, under applicable state privacy laws. Subject to those laws and the controller/processor allocation in Section 2, you may exercise available rights by contacting us as described in Section 17. We will verify requests as permitted by law and will honor rights to the extent applicable.
The Services may contain links to third-party websites or integrate third-party services that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third party before providing information.
The Services are operated from the United States and intended for users in the United States. If you access the Services from outside the United States, you understand that your information may be processed in the United States, where data-protection laws may differ from those in your jurisdiction.
We may update this Privacy Policy from time to time. We will post the updated version with a new “Last Updated” date and, for material changes, will provide additional notice as required by law, such as by posting a prominent notice on our website, sending an in-app notification, or emailing you. Your continued use of the Services after the updated Privacy Policy becomes effective constitutes your acknowledgment of the changes to the extent permitted by law.
